1. Agreement to Terms

By accessing or using the 28Fox Parenting Course mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

28Fox provides a digital parenting education platform. All purchases grant online access to video lessons and digital materials. No physical kit will be delivered.

28Fox offers:

• Course Videos: Streaming video content covering parenting techniques and child development
• Printable Materials: Downloadable flashcards and learning materials (digital files only)
• Daily Practice Reminders: Notifications to help you maintain consistent learning habits
• Community FAQ: A forum for parents to discuss questions and share experiences
• Trainer Tools: Interactive learning tools including Flashcard Speed Trainer and Counting Numbers Trainer

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age. The App is designed for parents and adults; it is not intended for children under 13.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Secure password
• OR sign in using Google Sign-In with your Google account

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4.3 Accurate Information

You agree to provide accurate, current, and complete information and to update your information as necessary.

4.4 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Pricing and Payment

5.1 All-Access Plan

5.2 Free Sample Content

Some videos and materials may be marked as free and accessible without payment. Paid content requires the All-Access plan purchase.

5.3 Billing and Payment

• Payments are processed through Razorpay
• Payment is charged at confirmation of purchase
• You authorize us to charge the applicable fees to your payment method
• All fees are in Indian Rupees (INR) and are non-refundable except as required by law

5.4 Access Duration

The All-Access plan provides 1 year of access from the date of purchase. Access automatically expires after 12 months. There is no auto-renewal.

5.5 Price Changes

We may change pricing at any time. Price changes will not affect purchases already made. Your continued use after a price change constitutes acceptance of the new price.

5.6 License

Your purchase grants you a personal, non-transferable license to view videos and print flashcards for home use. You may not share, redistribute, or commercially use the content.

5.7 Refunds

Refunds are handled by Apple according to their refund policy. Generally, all sales are final and non-refundable, except as required by law or Apple's policies. To request a refund, contact Apple Support.

6. Content and Intellectual Property

6.1 Our Content

All content provided through the App, including but not limited to:

• Course videos, text, graphics, images, and audio
• Flashcard images and training materials
• App design, software, and code
• Trademarks, logos, and branding

...is owned by 28Fox or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the App for personal, non-commercial purposes
• View and interact with course content for your personal learning

6.3 Restrictions

You may NOT:

• Copy, modify, distribute, sell, or lease any part of the App or content
• Reverse engineer, decompile, or attempt to extract source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App or content for commercial purposes without our written permission
• Share your account credentials with others
• Download or record videos or content (except as expressly permitted)
• Use automated tools (bots, scrapers) to access the App

6.4 User-Generated Content

If you post content in the Community FAQ or other interactive features, you grant us a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content in connection with the App. You represent that you own or have rights to any content you post.

7. Community FAQ and User Conduct

7.1 Acceptable Use

When using the Community FAQ, you agree to:

• Be respectful and courteous to other users
• Not post offensive, abusive, or harassing content
• Not post spam, advertisements, or promotional material
• Not share personal information of others without consent
• Not post content that violates laws or infringes intellectual property rights

7.2 Content Moderation

We reserve the right to remove any content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts of users who violate community guidelines.

7.3 Reporting Abuse

You can report abusive or inappropriate content using the in-app reporting feature. We will review reports and take appropriate action.

8. Disclaimers and Limitation of Liability

8.1 No Professional Advice

The App provides educational content about parenting. It is NOT a substitute for professional medical, psychological, or legal advice. Always consult qualified professionals for specific concerns about your child's health, development, or behavior.

8.2 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The content is accurate, complete, or up-to-date

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 28FOX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, punitive, or special damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the App
• Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless 28Fox and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content

10. Third-Party Services

The App integrates with third-party services:

• Google Sign-In: Governed by Google's Terms of Service
• Cloudflare Stream: Governed by Cloudflare's Terms of Service
• Apple In-App Purchase: Governed by Apple's Terms and Conditions

We are not responsible for third-party services or their terms. Your use of third-party services is subject to their respective terms and privacy policies.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Copyright and DMCA

We respect intellectual property rights. If you believe content in the App infringes your copyright, please contact us at admin@28fox.com with:

• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Deleting your account in the App settings
• Contacting our support team
• Canceling your subscription (if applicable)

13.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse or harass other users or our staff
• We are required to do so by law
• We discontinue the App or service

13.3 Effect of Termination

Upon termination:

• Your right to access and use the App will cease immediately
• We may delete your account and data (subject to legal retention requirements)
• Sections that by their nature should survive (e.g., disclaimers, indemnification) will remain in effect
• You remain liable for any outstanding fees

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India (Maharashtra), without regard to conflict of law principles.

14.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996, except as provided below.

You and 28Fox agree to:

• Resolve disputes on an individual basis
• Conduct arbitration in Thane, Maharashtra, India
• Waive the right to participate in a class action

14.3 Exceptions to Arbitration

The following disputes are NOT subject to arbitration:

• Claims for injunctive or equitable relief
• Disputes in small claims court (if they qualify)
• Intellectual property disputes

14.4 Opt-Out

You may opt out of arbitration by sending written notice to the address below within 30 days of first using the App.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 28Fox regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control (e.g., natural disasters, pandemics, war, terrorism, labor disputes).

15.6 Export Control

You agree to comply with all applicable export and import laws and regulations. You may not use the App in violation of applicable export laws.

15.7 Apple-Specific Terms

If you access the App via an Apple device:

• These Terms are between you and 28Fox, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support
• Apple is not liable for any claims related to the App
• You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country
• You are not on any U.S. government list of prohibited or restricted parties
